Will replacing the stock diverter valve with your upgraded diverter valve cause any issues with passing CA smog checks?

Cal smog checks on newer cars are about checking for codes and visual check. In the visual they are looking for things like non-stock intake that is not CARB approved. I would be surprised if they somehow noticed or cared about the diverter, which might legally need the CARB number because of location on the intake system but should have no impact on the emissions.
