AEM Intake - Legal?

I want to install an AEM intake on my 06 MX-5. Does anyone know if a car so equipped will pass California smog check. Thanks

My understanding is that it is "NOT" CARB legal yet....

Do you know why that would be? Isn't the Mazda Speed intake made by the same company (AEM) CARB legal? If the AEM intake is later determined to be CARB legal, would intakes installed earlier pass smog?

Yes, it's the same intake and both will become legal at the same time and once that CARB number issues it applies to all sold and unsold in equal manner.
